At the Westfield branch in Westfield, New York, an elder is cut off for circulating "false and slanderous reports, and not observing the order of the gospel." He refuses to surrender "the church book" and license.

False reports, order of the gospel Brother Paul charges Elder James Higby with "circulating false and slanderous reports, and not observing the order of the gospel." He presents "evidence unimpeachable … from Brother Higby's own mouth." At a conference in Springfield, Illinois, March 8, 1839, a James Higby is presented for ordination, but objections are raised (not ordained). WWJ 1:318.

James Higbee Jr. of Springfield, Illinois, is excommunicated in 1843. Times and Seasons, vol. 4 no. 14 (June 1, 1843), 216.
Cut off Based on the evidence "and the spirit he showed," James is found guilty and is cut off from the church.
Refuses to return records The council demands his license and "the church book." He refuses.
